Fine allegations : Davis, Lang appeal dismissal of defamation lawsuit against Boeheim, SU

Bobby Davis and Mike Lang appealed the dismissal of their defamation suit against Syracuse University men’s basketball head coach Jim Boeheim and the university on Tuesday.
Davis and Lang’s attorneys filed the appeal to the Appellate Division of the state Supreme Court in Rochester, according to an article published by The Post-Standard on Tuesday.
‘We are appealing the Court’s decision to shut the courthouse door on Bobby Davis,’ said Gloria Allred, an attorney representing Davis and Lang, in an email on Wednesday. ‘We are dedicated to protecting the rights of both Bobby Davis and Mike Lang.’
Davis and Lang accused Bernie Fine, Boeheim’s longtime assistant coach, of molesting them while they were ball boys at SU. After Boeheim defended Fine and called the stepbrothers liars, Davis and Lang filed a defamation suit againstBoeheim and the university. Fine has denied all allegations and has not been charged.
The defamation suit was dismissed last week after a judge ruled that Boeheim’s statements were opinions and not facts, and therefore were protected under free speech.
